RENTAL CONDITIONS

1 INCLUDED

1.1 Personal Accident insurance (PAI) with unlimited coverage for personal injuries towards the driver and passengers in the car, and injuries caused to third party.
1.2 Collision Damage Waiver (CDW) with NO EXCESS covering all damages caused to the vehicle if caused by single-car accident and where a third party is involved.
1.3 Theft protection is included with NO EXCESS (PROVIDING that the renter hands in a written declaration AND THE CAR KEYS)
1.4 Theft protection covers the vehicle, NOT personal items left inside the car - the car rental company is not responsible for personal items left or forgotten inside the car after the termination of the rental contract.
1.5 Scratches and damages to the bodywork, glass, wheels/tyres (also in case of puncture or blowout), front and rear lights, windscreens, undercarriage, clutch and towing expenses in case of damages, accident or breakdown.
1.6 Damages are ALSO covered if caused by a third party or by the renter himself (including co-drivers).
1.7 The aforementioned are covered PROVIDING THAT A WRITTEN REPORT IS SENT TO THE CAR RENTAL COMPANY INFORMING ABOUT THE DAMAGES, including images of the damages, a brief description of what has occurred, place, time and persons involved (we do not accept to be informed about damages at the end of the rental or after the termination of the contract) - We are friendly and easy to deal with and accept damage reports via WHATTSAPP.

2 NOT INCLUDED

2.1 Damages caused by any kind of negligence or negligent use of the vehicle.
2.2 Damages caused to the vehicle that has NOT been reported to the car rental company according to point 1.7.
2.3 Damage caused by the renter due to reckless driving or parking (such as damaging the rims or wheels by hitting the curb while parking).
2.4 Damages scratches and dents caused to the bodywork/undercarriage due to driving on non-signed roads (also known as "dirt tracks" or in Spanish "Carril")
2.5 Misuse of clutch, lost antennae, damages to upholstery, cigarette burns, extremely dirty interiors, loss/damage of keys, wrong re-fuelling, transport of pets, and expenses derived of the aforementioned.
2.6 Damages caused due to ignoring the car´s dashboard symbols.
2.7 Towing or propelling other vehicles.
2.8 Driving the vehicle outside of the Andalusia region without permission and insurance from the car rental company.
2.9 Using the vehicle after the termination of the rental period.
2.10 In case of breakdown /accident, abandoning the vehicle in a position that may cause further damage to it or stealth.
2.11 Traffic fines, speeding fines and parking fines: A flat fee of 15€ for handling applies.

3 DELIVERIES

3.1 We deliver all cars PERSONALLY 24/7/365 from 08:00-21:00 FREE of extra charges. We don’t use shuttle service.
3.2 For deliveries between 21:00 - 08:00 a fixed fee of 23€ is charged (the amount is entirely for the staff working late).
3.3 The fee applies from 21:00 sharp and onwards with no exceptions. It is the moment you come out and meet us in the arrivals hall that determines whether the fee is applicable or not - NOT the arrival time of your plane.
3.4 Delivery to holiday address/hotel per request has an extra cost of 25€ fixed fee.

4 CAR RETURN

4.1 Car return at Málaga airport is free of charge in between 08:00 - 21:00 hours.
4.2 For car return between 21:00 - 08:00 hours a fixed fee of 20€ applies (this is to cover parking costs in the early morning hours until staff picks up the car)
4.3 Car returns are done very SWIFTLY and CONVENIENTLY in the P-1 Parking store at Malaga airport, which is the multi storey car park situated in front of the terminal buildings only two-three minutes walk from the departures terminal.
4.4 Detailed car return instructions will be handed out to you when the car is delivered.
4.5 If the car is not returned according to the agreed any costs incurred by our staff in order to recover the vehicle shall be charged to the renter – this includes towing expenses, fines, and all cost derived thereof - DO NOT leave the car in the EXPRESS PARKING or PREFERENTE PARKING.
4.6 Car return at holiday address/hotel per request has an extra cost of 25€ fixed fee.

5 PAYMENT

5.1 Payment is done on arrival directly to the staff delivering the car.
5.2 You do NOT pay in advance, nor do we charge a "reservations fee" when you book the car.
5.3 Credit cards accepted: Visa and MasterCard (debit cards: see below)
5.4 WE DO NOT CHARGE OR "BLOCK" ANY AMOUNT on the payment card (i.e. deposits or excess).
5.5 Debit cards (Visa or MasterCard) are accepted PROVIDING that the first of the 16 digits is 4 or 5 - No exceptions made.
5.6 Cash, payment accepted in Euro, on the exact amount
5.7 The payment method mentioned in 5.5 is subject to producing a valid credit card/debit card in the renters own name.
5.8 The card WILL BE REGISTERED ON THE RENTAL CONTRACT (to serve as our guarantee in the event of missing fuel when the car is returned, traffic fines, negligent use etc.)

6 FUEL POLICY - CUSTOMER FRIENDLY AND FAIR

6.1 Our rates does NOT INCLUDE FUEL.
6.2 There will be NO UP FRONT FUEL CHARGES nor "refilling fee" involved.
6.3 The vehicle will be delivered with ½ a tank of fuel (or more) –The renter is to return it with THE SAME AMOUNT OF FUEL as when delivered.
6.4 The fuel level will be clearly and precisely marked on the rental contract signed by both parties and will be thoroughly checked when the car is returned.
6.5 Should the car be returned with less fuel in the tank than when delivered, the renters payment card will be charged fixed handling fee of 25€ + the missing fuel (the fuel level WILL be carefully verified at the end of the rental). In order to avoid handling fees we suggest refilling at the BP petrol station right at Malaga airport (not in Nerja or Marbella etc.)

7 EXTRAS - CHILD SEATS FREE

7.1 We supply child seats and booster seats (pillows) FREE of charge
7.2 Due to Spanish regulations, these MUST be mounted/fastened by the renter – NOT by the staff who delivers the car.
7.3 Child seats and boosters comply with European standards:
7.4 Except MAXI COSI, which can be mounted forward facing and backward facing, ALL child seats/boosters are FORWARD FACING.
7.5 All cars are equipped with the ISOFIX mounting system.

8 ADDITIONAL DRIVERS FREE

8.1 Four additional drivers are allowed per contract FREE of charge. One can be added online - the rest can be added to the rental contract on arrival (please remember that this service cost some 5-6€ per day per person with other rental agencies).
8.2 ALL Additional drivers must hold a valid driver´s license and must and SIGN THE CONTRACT.
8.3 For additional drivers not present when the car is delivered, please forward drivers license and ID scanned and attached per email.

9 EXTRAS – GPS

9.1 We supply GPS in English language (also called satnav) for 5€ per rental day, maximum 35€/rental.

10 DOCUMENTATION NEEDED

10.1 The renter/main driver must have held a drivers license for 2 years, and must be able to produce the following at the delivery of the vehicle:
- Valid passport or ID,
- Valid drivers licence
- Credit card/Debit Card - Visa or MasterCard
10.2 The credit card/debit cars used for payment MUST be in the renters/main drivers name.

11 AGE LIMITATION

11.1 Minimum age is 25 years with 2 years of driving experience.
11.2 For drivers aged 70 years or more, the SAME conditions applies except an insurance excess of 300€ for ALL CAR GROUPS.
11.3 The excess amount of 300€ for drivers 70 years of age or more cannot be waived.
11.4 NO excess amount will be charged up front (or "blocked) - nor will we charge any so-called "deposit".
11.5 The 300€ insurance excess is will ONLY BE CHARGED IN THE EVENT OF DAMAGES and according to the damages caused with the 300€ being the maximum amount that the client is responsible for.

12 NEGLIGENT USE

12.1 Negligent and non-adequate use of the vehicle is under no circumstances covered.
12.2 Costs and/or economic loss that the car rentals company may suffer as a consequence thereof shall be paid by the renter.
12.3 In particular, the following is considered negligent use: to damage wheels/tyres by hitting the curb while parking, circulating under the influence of alcohol or drugs, circulating beyond the termination of the contract, excessive speeding, driving on non-signed roads/tracks, wrong use of clutch, reckless driving, reckless parking, circulating without being registered as a recognized driver on the contract, not respecting the dashboard warning symbols, to disregard traffic signs.

13 RENTERS OBLIGATION IN CASE OF DAMAGES/BREAKDOWN

13.1 It is the renters obligation to inform the car rental company about breakdown/damage immediately when it happens or as soon as possible, maximum within 24 hours after the incident has occurred.
13.2 A brief declaration signed by the renter, with description of the occurred, including time, place, circumstances and persons involved and photos of the damages caused must be handed in to the car rental company.
13.3 The damage report can be sent via email with photos attached or via WHATTSAPP with a photo of a handwritten signed document + photos of the damages.
13.4 In case of break down or accident, the renter must take all measures not to abandon the vehicle in a position that may expose it to suffering further damages which will be considered negligence.

14 RENTERS OBLIGATION IN CASE OF ACCIDENT

14.1 To immediately call the police and make a police report, and if necessary, declare at the nearest police station (Policia Local or Guardia Civil).
14.2 To inform the car rental company immediately or, as soon as possible maximum within 24 hours.
14.3 If one or more third parties are involved the following details MUST by recorded by the renter:
- License plates of ALL vehicles involved
- Full Name, ID and address in home country of ALL drivers involved + telephone number.
- Insurance company of all parties (compañia de seguros)
- Insurance license number (numero de poliza) of all parties if available.
- Names and contact details of witnesses, if any.
14.4 If the third party cannot identify himself, or refuses to identify himself, his car registration plates must be noted down, pictures taken if possible, and the Police called immediately.
14.5 The "Declaracion Amistosa de Accidente" or "friendly declaration" which can be found in the car should be filled in by the renter and the third party, and a copy of this document handed in to our staff.
14.6 Damages that are not notified promptly as per point 1.7 and 13.1 will be charged to the renter.
14.7 Wrong information regarding damages, whether verbal or written, WILL NOT BE ACCEPTED, and damages will be charged to the renter.
14.8 The car rental company reserves the right to terminate the rental contract.

15 CANCELLATIONS

15.1 Cancellations can be made FREE OF CHARGE until 24 hours before the commencing of the rental.
15.2 For cancellations made in less than 48 hours before the commencing of the rental contract a penalty of 20% of the confirmed price will apply.
15.3 For cancellations made in less than 24 hours before the start of the rental contract, a penalty of 30% of the confirmed price will be applied.

16 VEHICLES AND GROUPS

16.1 The cars are divided into "car groups" or categories according to their size, amount of doors, type of car and capacity.
16.2 We GUARANTEE to deliver a car with the specifications as per the car group reflected in the booking confirmation.
16.3 We DO NOT guarantee to deliver a specific make or model, nor with a specific color, engine size, engine type, HP etc.
16.4 All images of cars (which we try our best to keep updated according to our current fleet) and the mentioning of specific makes and models are for your orientation and guidance only.

17 EXTENSIONS OF THE RENTAL CONTRACT

17.1 Extensions of rental contracts can in most cases be granted. Request for extension of the rental period is to be done at least 24 hours before its termination. The car rental company may not be able to grant extensions during peak season if all vehicles are rented out.

18 LEAVING THE SPANISH PENINSULA

18.1  It is legal to drive the car into Gibraltar but WE ADVISE YOU NOT TO DO SO due to the numerous conflicts and long queues at the border. We advise you to park on the Spanish side and walk there. Roadside assistance is NOT COVERED in Gibraltar.

19 DOUBTS REGARDING THESE RENTAL CONDITIONS

19.1 Doubts regarding our rental conditions should be clarified by email or telephone before submitting a reservation request.

20 BREAK OF CONTRACT

20.1 The car rental company reserves the right to terminate the contract without notice if the renter fails to comply with the rental contract.
